Does the FTC Safeguards Rule apply to my accounting firm or insurance agency?
It depends on the services you provide. The FTC Safeguards Rule covers non-bank financial institutions such as tax preparers, mortgage brokers, finance companies and advisers that aren't registered with the SEC, so many CPA and tax firms are covered. Insurance agencies generally follow state insurance rules instead, and banks and credit unions follow their own regulators' versions of the GLBA standards. Your attorney or compliance officer makes the final call, and we can help you work through it.
Can you make our bank or firm "GLBA certified"?
No one can. There is no official GLBA or Safeguards Rule certification. Compliance is ongoing and remains your firm's responsibility. We help you put the required technical safeguards in place, complete risk assessments and keep documentation ready for examiners, auditors and insurers.
