Texas SB 2610 and Small Business Cybersecurity
Texas Senate Bill 2610 took effect September 1, 2025. It applies to Texas businesses with fewer than 250 employees that own or license computerized data containing sensitive personal information. If such a business implemented and maintained a qualifying cybersecurity program at the time of a breach, people harmed by the breach can't recover exemplary (punitive) damages from it.
What counts as a qualifying program scales with size: password policies and employee cybersecurity training for businesses with fewer than 20 employees, the CIS Controls Implementation Group 1 for 20 to 99 employees, and a recognized cybersecurity framework for 100 to 249 employees.
